2. SCOPE

These Terms and Conditions govern the online sale of original artworks, fine art prints, commissioned artworks, and related products offered through the Website.

By placing an order through the Website, the Customer accepts these Terms and Conditions in full.

3. CUSTOMERS

Products may be purchased by:

• Consumers;
• Businesses;
• Interior designers;
• Hotels;
• Galleries;
• Professional entities and organizations.

4. PRODUCTS

Images displayed on the Website are provided for illustrative purposes only.

Each original artwork is unique and hand-created by the Artist.

Minor variations in colour, texture, dimensions, finish, and appearance compared to images displayed on screens shall not constitute a defect or non-conformity.

Fine art prints may be produced and fulfilled through carefully selected print-on-demand providers.

5. AVAILABILITY OF ARTWORKS

Original artworks are generally available as single unique pieces.

Should an artwork become unavailable after purchase due to exceptional circumstances, the Customer will be informed promptly and any payments received will be refunded in full.

6. PRICES

All prices are displayed in Euro (€) unless otherwise stated.

The Seller operates under the Italian Regime Forfettario tax regime and therefore does not charge VAT on sales, in accordance with applicable Italian legislation.

Shipping charges, customs duties, import taxes, brokerage fees, and other charges imposed by authorities in the destination country may be payable by the Customer.

7. PAYMENT

The payment methods displayed on the Website are accepted.

Orders are considered confirmed only once payment has been successfully processed and received.

The Seller reserves the right to refuse or cancel transactions suspected of fraud, unauthorized use, or other unlawful activity.

8. ARTWORK RESERVATIONS

Customers may reserve an original artwork by paying a non-refundable deposit equal to 25% of the listed purchase price.

Reserved artworks will be held for a maximum period of 30 days unless otherwise agreed in writing.

The balance must be paid in full before the artwork is shipped or delivered.

If the Customer decides not to proceed with the purchase, the reservation deposit will not be refunded.

Should the Seller be unable to complete the sale, any deposit paid will be refunded in full.

9. COMMISSIONED ARTWORKS

The Seller accepts commissions for custom artworks.

A minimum deposit of 50% is required before work commences.

Once work has begun, the deposit is non-refundable.

Commissioned artworks are custom-made products created according to the Customer's specifications.

As such, commissioned artworks are exempt from the statutory right of withdrawal applicable to standard consumer purchases, where permitted by law.

10. SHIPPING

The Seller ships worldwide.

Estimated delivery times are provided as guidance only and are not guaranteed.

The Seller shall not be liable for delays caused by shipping carriers, customs authorities, weather conditions, industrial action, government restrictions, or other circumstances beyond reasonable control.

11. CUSTOMS AND IMPORT DUTIES

For deliveries outside the European Union, the Customer is responsible for any customs duties, import taxes, VAT, brokerage fees, or other charges imposed by local authorities.

12. INSPECTION UPON DELIVERY

Customers are required to inspect their package immediately upon receipt.

Visible damage must be reported to the courier at the time of delivery and communicated to the Seller within 48 hours, together with photographic evidence.

13. RIGHT OF WITHDRAWAL

Consumers have the right to withdraw from a purchase within 14 days of receiving the product without giving any reason, subject to applicable legal exceptions.

To exercise this right, the Customer must notify the Seller in writing using the contact details provided on the Website.

Returned products must be shipped back within 14 days of notification.

Returned products must be unused, undamaged, and securely packaged.

Return shipping costs are the responsibility of the Customer unless otherwise required by law.

Refunds will be processed in accordance with applicable consumer protection legislation.

14. EXCLUSIONS FROM THE RIGHT OF WITHDRAWAL

The right of withdrawal does not apply to:

• Commissioned artworks;
• Custom-made products;
• Personalized items;
• Any products exempted under applicable consumer protection laws.

15. LEGAL WARRANTY

Consumers are entitled to all statutory rights and remedies available under applicable consumer protection legislation.

Nothing in these Terms and Conditions shall limit or exclude rights that cannot legally be waived.

16. INTELLECTUAL PROPERTY

All artworks, images, photographs, texts, designs, logos, graphics, and Website content remain the intellectual property of Germaine Stafford unless otherwise stated.

The purchase of a physical artwork does not transfer copyright or reproduction rights.

No artwork, image, photograph, or content may be copied, reproduced, distributed, published, or used commercially without the prior written consent of the Seller.

17. LIMITATION OF LIABILITY

To the maximum extent permitted by law, the Seller shall not be liable for indirect, consequential, incidental, or special damages arising from the use of the Website or the purchase of products.

Nothing in these Terms limits any rights granted to consumers under mandatory law.

18. PRIVACY

Personal data is processed in accordance with the Website Privacy Policy and applicable data protection legislation, including the General Data Protection Regulation (GDPR).

19. GOVERNING LAW

These Terms and Conditions shall be governed by and interpreted in accordance with Italian law.

Consumers residing outside Italy shall retain any mandatory protections granted under the laws of their country of residence where applicable.

20. ONLINE DISPUTE RESOLUTION

The European Commission provides an Online Dispute Resolution (ODR) platform available at:

The Seller remains available to discuss and seek amicable resolution of any disputes before legal proceedings are initiated.

21. AMENDMENTS

The Seller reserves the right to modify these Terms and Conditions at any time.

Changes shall become effective upon publication on the Website and shall not affect orders already concluded.

22. LANGUAGE

These Terms and Conditions are originally drafted in Italian.

An English translation may be provided for the convenience of international customers.

In the event of any inconsistency or conflict between the Italian and English versions, the Italian version shall prevail.
